Auction & Lightning Lot Terms & Conditions

The all important terms & conditions for our Have a Heart Appeal auctions & lightning lots.

  1. Definitions and Introduction

1.1  In these terms and conditions the following words and phrases shall have the following meanings (and, where applicable in these terms and conditions, the singular shall include the plural):

 

 

“Auction”

The auction running on the Participating Radio Station during the Term

“Auction Line”

“Bid Period” 

The period, as announced on-air, during which a Participant may bid for a particular item in an Auction

“Competition Terms and Conditions”

“Conditions”

These terms and conditions relating to the Auction and Lightening Lots on the Participating Radio Station together with the Competition Terms and Conditions

“Global Radio”

Global Radio Services Limited (registered company number 6251684) of 30 Leicester Square, London, WC2H 7LA. 

“Lightning Lot”

The charity sale running on the Participating Radio Station during the Term

“on-air”

Something broadcast on the Participating Radio Station

“Participant” or “you”

A person who participates in the Auction and/or Lightening Lots

“Participating Radio Station”

The Heart radio station owned and managed by Global Radio

“Term”

The dates and times set out in Clause 2.2 of these Conditions

“Website”

1.2       These Conditions together with the Competition Terms and Conditions (with the specific exception of clauses 2.1 to 2.6 of the Competition Terms and Conditions) shall apply to the Auction and Lightning Lots Appeal. Participation in any Auction or Lightning Lot shall be deemed an unconditional acceptance by you of these Conditions.

1.3       In the event that these Conditions conflict with the Competition Terms and Conditions, the provisions of these Conditions shall prevail.

1.4       References to “we”, “us” and “our” shall be to Global Radio and/or the Participating Radio Station.

2.      Auction and Lightning Lots

2.1    During the Term, listeners to the Participating Radio Station will be invited to bid for items in the Auction or purchase items in the Lightning Lots by telephoning the Auction Line.

2.2    The Auction and Lightning Lots will be open at certain times, as announced on-air, between the following hours:

6am and 9am from Monday 27th to Wednesday 29th February 2012;

6am and 9am from Monday 5th to Friday 9th March 2012;

10am and 1pm from Monday 5th to Friday 9th March 2012; and

10am and 7pm on Friday 9th March 2012.

7am - 8am on Thursday 15th March 2012.

2.3    To make a bid in an Auction or to participate in a Lightning Lot a Participant must call the Auction Line only when directed to do so on-air and during the specified periods as announced on-air only.  Calls to the Auction Line are charged at local rates from a BT landline.  Calls from other networks and mobile phones may vary.  Please consult your service provider for further information.  Any Participant using a telephone which is not his or her own should ask for the permission of the owner of the telephone before calling the Auction Line.

2.4    Auctions and Lightning Lots will be open to listeners of either a particular radio station, or across the entire network, of the Participating Radio Station.  Where Auctions and/or Lightning Lots are open to listeners across the entire network of the Participating Radio Station this will be clearly stated on-air.

2.5    Full details of all Auctions and Lightning Lots will be available on the Website including any specific terms & conditions for each lot and on which station/s of the Participating Radio Station the particular Auction or Lightning Lot will take place.

2.6    Bids for an Auction item will only be taken during the Bid Period. The level that bids have reached will be broadcast on-air from time to time during the Bid Period. If at the end of the Bid Period there are two or more Participants active on the Auction Line, a final silent bid will be taken from each. The highest bid received from any Participant by the end of the Bid Period will secure the item.  The successful Participant will be contacted by the Participating Radio Station.

2.7    Items to be sold by Lightning Lot will be available for purchase when announced on-air.  The Auction Line will remain open until all items in the particular Lightning Lot have been sold and there will be an on-air announcement that all items have been sold. 

2.8    The offer of an Auction item on-air shall constitute an offer which will be deemed to be accepted by the highest bidder during the Bid Period. 

2.9    The offer of an item in a Lightning Lot shall constitute an offer which will be deemed to be accepted by a Participant calling the Auction Line and making payment for such item.  The offer for items in each Lightning Lot will be open during the period in which items remain unsold and shall be deemed to have been withdrawn upon sale of the last item in the relevant Lightning Lot.

2.10  Participants must be 18 years of age or over.  We reserve the right to verify the eligibility of all entrants.

3.    Payment and delivery

3.1    Payment for an item must be by debit or credit card.  The amount to be paid, having been deducted from or charged to the Participant’s debit or credit card, shall constitute consideration.  All Participants must ensure that, prior to calling the Auction Line, they are able to pay for any item which they wish to bid for or purchase.  The actual owner of the credit or debit card must personally provide his or her credit or debit card details on the Auction Line.

3.2    Title in the items successfully bid for or purchased shall not pass on to the Participant until such time as payment for the item has been received by the Participating Radio Station and delivery has taken place.

3.3    Delivery of a prize or voucher with the prize details will be made within 28 (twenty eight) days to the address specified by the Participant provided that such address must be within England, Scotland, Wales or Northern Ireland. When an item is delivered, risk of damage to, or loss of, the item passes shall pass to the relevant Participant. We reserve the right to require photo ID from the successful Participant upon delivery.

3.4    Liability

All items offered for either an Auction or a Lightening Lot shall be subject to availability and we shall not be liable for any claims, expenses, costs and/or any losses (including, but not limited to, loss of profits, indirect, pure economic and consequential losses or otherwise) or any damage (save for death or personal injury arising from negligence) suffered by any Participant.

3.5    All matters relating to the Auction and/or Lightening Lots shall be at our sole discretion. 

3.6    Notwithstanding that a successful bid has been received or a pledge for an item has been given, in the event that we discover that (i) the Participant was or should have been ineligible to make a bid for an item or to purchase a Lightening Lot item, or (ii) that the Participant should have been declared invalid for any other reason whatever (at our absolute discretion), we reserve the right to reject the bid or purchase. In such circumstances, we reserve the right to offer the prize to the second highest bidder or offer the Lightening Lot item to the Participant who was next in line to purchase the item.

3.7    We shall have no liability to any Participant whose telephone call is not received by us for any reason whatever.
