A Kings Langley man has been cleared of raping a woman who had got into his bed in the early hours of New Year's Day.
29-year-old Andrew McKenzie was found not guilty by a jury at St Albans crown court.
The 8 women and 4 men were unable to reach a verdict on a second charge of attempted rape on January 1 2014.
Prosecutor Michael Roques told Judge Marie Catterson that the crown was not seeking a retrial and Mr McKenzie, of Watford Road, was freed from the dock.
The trial heard how the woman had gone out drinking with friends on New Year's Eve 2013 and ended up at Mr McKenzie's home and shared his bed.
Mr McKenzie said the woman had consented to sex with him and he said he thought she had enjoyed it.
